1. About the Marketplace

Smart Care Activities provides an online marketplace where organisations and individuals can advertise equipment, products and services for sale or other lawful transactions.

We provide the marketplace only. We do not own, inspect, store, buy or sell the goods advertised and are not a party to any agreement made between buyers and sellers unless expressly stated otherwise.

2. Eligibility

You must ensure that you are legally entitled to enter into binding agreements and that any information supplied when registering is accurate, complete and kept up to date.

You are responsible for maintaining the security of your account and for all activity carried out using your login credentials.

3. User Accounts

You agree to keep your password confidential and to notify us immediately if you believe your account has been accessed without your permission.

• Provide accurate registration information.
• Keep your contact details up to date.
• Use the marketplace only for lawful purposes.
• Not share your account with another person.

4. Listings

Sellers are responsible for ensuring that all listings are accurate, truthful and not misleading. Listings should accurately describe the goods or services being offered and include sufficient information for buyers to make an informed decision.

• Descriptions must be accurate.
• Photographs should fairly represent the item.
• Known defects should be disclosed.
• Prices should be clear and not misleading.
• You must have the legal right to advertise the item or service.

5. Buying and Selling

All negotiations, purchases and sales take place directly between buyers and sellers. Smart Care Activities does not guarantee the quality, condition, ownership or suitability of any listing and does not participate in the transaction unless expressly stated.

Buyers are responsible for carrying out their own due diligence before committing to any purchase or agreement.

6. Payments

Unless expressly stated otherwise, Smart Care Activities does not process payments, hold funds, provide escrow services or guarantee payment between buyers and sellers.

Buyers and sellers are solely responsible for agreeing payment methods, invoicing, collection, delivery, transportation, installation, insurance and any taxes or charges that may apply.

7. Prohibited Listings

You must not advertise, offer for sale or otherwise publish listings that are unlawful or misleading.

• Illegal or stolen goods.
• Counterfeit products.
• Items that infringe copyright, trademarks or other intellectual property rights.
• Fraudulent or misleading listings.
• Goods or services that you are not legally entitled to sell.
• Any content that is offensive, abusive or unlawful.

8. Suspension and Termination

We reserve the right to remove listings, suspend accounts or permanently terminate access to the marketplace where we reasonably believe these Terms have been breached or where it is necessary to protect the marketplace or its users.

We may remove listings that are inaccurate, misleading, duplicated, unlawful or otherwise unsuitable for publication.

9. Intellectual Property

You retain ownership of the content you upload to the marketplace. By publishing listings, photographs or documents, you grant Smart Care Activities a non-exclusive licence to display, store and reproduce that content solely for the purpose of operating and promoting the marketplace.

10. Limitation of Liability

To the fullest extent permitted by law, Smart Care Activities shall not be responsible for disputes between buyers and sellers, inaccurate listings, defective goods, failed transactions, payment disputes, delivery issues or any direct, indirect or consequential loss arising from use of the marketplace.

Users are responsible for carrying out their own checks before entering into any transaction and should obtain independent advice where appropriate.

11. Changes to these Terms

We may amend these Terms and Conditions from time to time. Any updates will be published on this page together with the revised "Last Updated" date. Continued use of the marketplace after changes have been published constitutes acceptance of the updated Terms.
